Cookies: definitions, characteristics and application of the regulations

Cookies are small text files that the sites visited by the User send and record on his computer or mobile device, to then be retransmitted to the same sites on the next access. Thanks to cookies, the site remembers the User’s actions and preferences (such as, for example, login data, chosen language, font sizes, other display settings, etc.) so that they do not have to be indicated again when the User accesses the site again or browses the pages of it. Therefore, cookies are used to perform computer authentication, session monitoring and storage of information about the activities of Users who access a site and may also contain a unique identification code that allows keeping track of the User’s navigation activity within the site itself for statistical or advertising purposes. While browsing a site, the User can also receive cookies from sites or web servers other than the one he is visiting on his computer or mobile device (so-called “third party” cookies). Some operations could not be performed without the use of cookies, which in certain cases are, therefore, technically necessary for the functioning of the site.

There are various types of cookies, depending on their characteristics and functions, and these can remain on the User’s computer or mobile device for different periods of time: the so-called session cookie, which is automatically deleted when the browser is closed; the so called persistent cookies, which remain on the User’s equipment until a pre-established deadline.

According to the legislation in force in Italy, the express consent of the User is not always required for the use of cookies. In particular, “technical cookies”, which are cookies used for the sole purpose of carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary to provide a service explicitly requested by the User, do not require such consent. In other words, these are cookies that are essential for the operation of the site or necessary to perform activities requested by the User.

Among the technical cookies, which do not require an express consent for their use, the Italian Authority for the protection of personal data (see Prov. Gen. “Identification of the simplified procedures for the information and the acquisition of consent for the use of cookies – 8 May 2014 “) also includes:

  • “analytics cookies” when used directly by the site operator to collect information, in aggregate form, on the number of Users and how they visit the site,
  • navigation or session cookies (for authentication),
  • functionality cookies, which allow the User to navigate according to a series of selected criteria (for example the language) in order to improve the service rendered to the User.

On the other hand, prior consent from the User is required for “profiling cookies”, i.e. those aimed at creating profiles relating to the User and used in order to send advertising messages in line with the preferences expressed by the same when browsing the net.

Types of cookies used by the site and possibility of (de-) selection

The Site uses the following cookies and offers options to (de-) select the same, bar for third-party cookies for which the User must refer directly to the selection and de-selection methods of the respective cookies indicated below by link:

  • Technical – navigation or session cookies, strictly necessary for the functioning of the Site or to allow the User to take advantage of the contents and services requested.
  • Technical-analytics cookies, which allow the understanding of how the Site is used by Users. With these cookies, information on the identity of the User is not collected, nor any personal data. The information is processed in an aggregate and anonymous form.
  • Technical-functional cookies, which are used to activate specific site features and a series of selected criteria (for example the language) in order to improve the service rendered.  ATTENTION: the Site may not be available or some services or certain functions of the Site may not be available or may not function properly in case technical and / or functionality cookies are disabled and the User may be forced to modify or manually enter some information or preferences each time he visits the Site.
  • Third-party cookies, i.e. cookies from sites or web servers other than that of the Owner, used for the purposes of such third parties, including also profiling cookies. It should be noted that these third parties, listed below together with the related links to their privacy policies, are independent controllers of the data collected through the cookies they use; therefore, the User must refer to the respective personal data processing policies, information and consent forms (selection and de-selection of the respective cookies) indicated below (as specified in the Prov. Gen. “Identification of simplified procedures for the information and the acquisition of consent for the use of cookies” – 8 May 2014):
